Our office has specialized in providing counseling to domestic violence victims and education for domestic violence offenders since 1992. Over the years we have developed our own prototypes and have received referrals from a wide variety of community programs and mandating authorities since that time. James J. Foster & Associates, Ltd is an approved provider for domestic violence educational services to offenders by the state of NH. Domestic Violence is a commonly occuring phenomenon in our society today. It is the most frequently prosecuted crime in most district courts throughout the country.


Law

The statutes that are considered the domestic violence laws usually include: assault, criminal threatening, criminal trespassing, criminal mischief, interfering with the reporting of a crime, false imprisonment, violation of a restraining order, stalking, attempted murder, murder and kidnapping. Domestic violence occurs when one party commits one of these crimes against another party within an intimate relationship. Most courts when hearing domestic violence cases have established protocols for recommending evaluations or screenings. These protocols are typically defined by each state.  Referrals for screenings are requirements of the defendent to find and apply to an appropriate state approved program. An evaluation is a tool designed to identify the individuals needs. 

Victims

Victims of domestic violence are both men and women. Any child who is directly abused or who witness domestic violence are viewed as victims. Most states have established for protecting the rights of victims and compensating victims for treatment, medical and/or funeral expenses.
